In the following terms & conditions the “Client(s)” shall be those persons defined at the time of the booking. “Photographs” and the” Works” means all photographic material furnished by Ludirak Photo whether transparencies, negatives, prints, digital files or any other type of physical or electronic material in existence now or yet to be developed. These terms & conditions cannot be varied in any way by the Client(s) unless such conditions are expressly agreed by Ludirak Photo in writing. By booking with Ludirak Photo you agree to and understand the terms and conditions.

1. Copyright
Ludirak Photo retains the entire copyright of the Photographs and Works in perpetuity.  Where reproduction of Works has taken place and settlement has not been made, Ludirak Photo will make such charges to the publisher of those images.

A request must be made prior to the event in writing if the Clients does not wish to have their images advertised.

2. Display
The Client(s) hereby agrees and allows Ludirak Photo to display any Works to generally promote the business in advertising, brochures, magazine articles, websites, sample albums and social media.

3. Coverage and Reproduction
Works taken during the course of the photo session will be at the discretion of Ludirak Photo although every effort will be made to comply with the Client(s) requirements.  Ludirak Photo shall be granted artistic license in relation to the poses photographed and the locations used. The judgement of Ludirak Photo regarding these matters shall be deemed correct. 

Ludirak Photo shall endeavor to photograph all individuals as requested by the Client(s), however takes no responsibility for any obstructed view should this be the case.

Due to a variety of lighting conditions and the limitations of digital sensors, some colors may alter throughout a set of Works.  Ludirak Photo will not be responsible for Photographs that are not produced due to technical failure. 

Where time is of the essence Ludirak Photo entirely at their own discretion may accept an instruction given orally.  In this event Ludirak Photo shall accept no liability for any error in executing the order.

 

4. Deposit & Payment
An upfront 50% deposit and Client(s)’s full acceptance of the terms and conditions as published at: www.ludirakphoto.com/terms is required to secure the proposal session.  The deposit will be deducted from the cost of the Client(s)’s chosen package when calculating the final balance due.

Checks and major debit & credit cards are accepted.  Full payment must be made before images are released.

Fees will apply for extra hours, additional retouching and graphics on Photographs. Pets and Make-up artist carry an additional photo session fee.  A quote will be issued before any extra work begins and the Client(s) will settle the outstanding invoice at the time of order. 

 

5. Delivery

Photographs and Works will be ready for viewing within 1-2 weeks after the proposal session.  The Client(s) will receive an email invitation to view the gallery of the raw images via www.pixieset.com.  Photographs and Works will be kept on the on-line gallery for 3 months then will automatically delete from the server.  Edited Photographs and Works are final.

 

6. Force Majeure
Ludirak Photo will endeavor to put the Client(s) in touch with another company in the event they are unable to attend on the photo session date due to any cause beyond their reasonable control e.g. sudden illness, injury, victim of crime, flooding etc.

In the event of cancellation by Ludirak Photo, or in the very unlikely event of total photographic failure, liability shall be limited to a full refund or any fees unpaid.

 

7. License of Use and Ownership
For personal use only; the Photographs and Works may not be used in any way whatsoever in which the Client(s) charge money, collect fees, or receive any form of remuneration.  Photographs for commercial use carry additional licensing fee, contact Ludirak Photo for more details.

The License to Use comes into effect from the date of payment of the relevant invoice(s). No use may be made of the Photographs and Works before payment in full of the relevant invoice(s) without express permission from Ludirak Photo in writing.  Where uses of Photographs and/or Works are made which breach the License to Use; further charges will be made by Ludirak Photo.

8. Third Party Printing

By placing an order with Ludirak Photo, you are committing to purchasing the ordered products.  Ludirak Photo cannot take responsibility or liability for color balance or quality of any prints.  All orders are presumed to have been received in good condition unless the Client(s) notifies Ludirak Photo in writing of any discrepancy or error within 14 days of receipt. 

 

9. Returns Policy 

All Photograph products are non-refundable. Orders cannot be cancelled due to the custom nature of the products.  Incorrectly supplied items and items of poor quality can be returned and will be replaced at no extra charge to the Client(s). Returns will not be considered for incorrectly ordered items or items ordered in error. 

 

10. Travel Fees
For attendance at locations or venues over a 5-mile radius of the service area, an up-front travel fee will apply where appropriate unless otherwise stated.

 

11. Cancellation Policy
Cancellation or rescheduling a photo session should be done within 48 hours.  Confirmed photo sessions are subject to weather conditions.  Each Client are allowed two rescheduling credits for their photo sessions.  Should the Client(s) be more than 15 minutes late, no-show or less than 48 hours of cancellation will result in forfeiting the photo session and their fee.

12. Personal Accident
Any directions issued to Client(s), their guests or employees during a photo session are deemed to be at said persons own risk. Ludirak Photo cannot be held responsible for any personal accidents during a photo session.

 

13. Complaints Procedure
Address any complaints to Ludirak Photo by email to hello@ludirakphoto.com.  We will endeavor to respond to any complaint within 5 working days per receipt.

14. Promotional & Special Offers
Limit one (1) coupon per purchase on product/quantity specified.  No more than one (1) identical per household.  May not be combined with other offers.  May not be used as gift cards.  Not redeemable for cash.  Not eligible in all states.  Void where prohibited.
